Terms & Conditions

It is important that the website owner has Terms & Conditions and appropriate policies on the website.  Terms & Conditions are a binding contract between the website user and the website owner. In New Zealand, it is a requirement by law to have a Privacy Policy.

Let's break down some of the reasons you need Terms & Conditions on a website:

  • > Prevent Abuses - sets the rules and guidelines that users must agree to and follow in order to use and access the website. Include the necessary sections to inform users of the guidelines for using the website, and what happens if users are abusing your website. Examples of actions of abuse can include spamming other users, posting defamatory content or attempting to infect the website with malware.
  •
  • > Ownership of the Content - The website owner is the owner of the logo, content, the design of the website, information etc. In the Terms and Conditions, the user can be informed that the owner of the website is also the owner of such content and that the content is protected by international copyright laws.

ECommerce sites are advised to incorporate a number of other sections. These include:

  • > Description disclaimer - many sites include a disclaimer that states that while they attempt to ensure that all product descriptions are accurate, there is no guarantee that they are error-free.
  •
  • > Price - a statement that prices are correct at the time of publication but are not guaranteed until the time of ordering as they may fluctuate even during short periods of time.
  •
  • > Returns and refunds policy - under what circumstances returns will be accepted; who is responsible for paying postage costs; and when clients can expect to receive a refund.
  •
  • > Most banks and credit card merchants require you to have a policy around payments, this is an ECommerce Terms of Use Policy
  •

A website owner can have the option to provide their own Terms & Conditions or to use the templated documents that Zeald Provide.

If they have opted to use Zealds documents we copy and paste the information into the website from the links provided later in this lesson.

If the customer has supplied their own Term & Conditions then the process to upload these is exactly the same.

Returns Policy

While the Returns or Refund Policy Information is requested from the a customer when they build a website, the customers very often do not have these in place, that is okay they can add them in later.

Here is a generic placeholder that will assist you in completing this section.

We do not have to give a refund if you change your mind about a purchase — so please choose carefully. If the product you have bought is faulty, we will provide a remedy as required by the Consumer Guarantees Act.
